The Trump Administration Seeks Supreme Court Permission for State Guard Troop Deployment in Chicago Area
On Friday, the government submitted an urgent appeal to the US supreme court, asking for authorization to station state guard forces to Chicago and surrounding areas.
This step is part of a broader campaign to widen the domestic use of the military in a number of urban centers under Democratic control.
Judicial Challenge Over Military Presence
In an emergency filing, the justice department pressed the judiciary to set aside a lower court ruling that had halted the stationing of a few hundred national guard members to the Chicago region.
The presiding judge had expressed skepticism about the government's reasoning for sending troops, questioning its rationale in considering regional circumstances.
A federal appeals court supported the previous order on midweek, leaving the activation on pause while the court case moves forward.
Administration's Arguments
The top government lawyer, acting for the government, wrote in the latest petition that federal agents have often been “intimidated and assaulted” in Chicago and the suburb of Broadview community.
This area is home to an federal immigration detention facility.
The president has already sent military reserve units to Chicago and the city of Portland, after prior sendings to LA, Memphis, Tennessee, and Washington, District of Columbia.
The administration has argued that armed forces involvement is required to reduce protests and bolster border control.
Political Pushback
Opposition leaders have strongly opposed the action, claiming that the administration's assertions are inflated and politically motivated.
They allege the administration of misusing his power to retaliate against critics.
The judiciary have also expressed doubt about the White House's description of ongoing incidents.
Local leaders say that demonstrations over immigration enforcement have been primarily limited and calm, contrasting with the president’s portrayal of “war zone” situations.
Statutory Grounds
At the center of the dispute is the government's invocation of a US code allowing the commander-in-chief to federalize the national guard only in situations of uprising or when “unable with the regular forces to carry out the regulations of the US”.
The government maintains that the forces are essential to defend government buildings and officers from protesters.
Latest Developments
In recent weeks, the White House nationalized several hundred members of the state guard of Illinois and directed more Texas-based troops into the state.
As city officials condemned the move, the president intensified his language, calling on the arrest of Chicago’s mayor and the state's chief executive, the two Democratic officials, charging them of failing to safeguard immigration officers.
Illinois and the city of Chicago jointly sued the White House to halt the sending.
On October 9, district Judge April Perry, appointed by Joe Biden, handed down a preliminary order blocking the directive.
Regional Incidents
Meanwhile in the city, at least 11 people were taken into custody outside the ICE facility in Broadview following intense clashes between local police and protesters.
